Ahmad Brooks is in some troubbbllleeeeee.
The 49ers linebacker is reportedly awaiting a decision by the Santa Clara County DA’s office on whether he’ll be charged with assault after he allegedly smashed a beer bottle on 49ers teammate defensive lineman Lamar Divens three times on the head last month. According to BANG, an arrest warrant for Brooks has been put on hold until the DA’s office can figure out whether to charge Brooks with a felony, a misdemeanor or nothing at all.
The alleged incident happened in the early hours of June 8 outside of Brooks’ house in San Jose after a night at the bars downtown. No surprise, the details are ugly. Brooks allegedly beat Divens, who drove, with a bottle on the head and punched him in the face over an argument over Brooks’ car keys. Brooks even allegedly threatened to get a gun. Over car keys! So, yeah, never go drinking with Ahmad Brooks.
Two 49ers players — Lawrence Okoye and Mike Purcell, according to the Sac Bee — reportedly were witnesses to the assault. Divens required three stitches. If charged, Brooks faces up to four years in jail. Brooks has an ugly past of run-ins with the law and authority, including a separate assault case against a woman, all of which is reportedly playing into the DA’s decision. Oh, by the way, the 49ers and Brooks agreed on a six-year, $44.5 million extension last year.

According to the application for Brooks’ arrest, the incident unfolded after Brooks, Divens and other 49er players spent the evening of June 7 at different players’ houses. Eventually they decided to go to downtown San Jose and keep drinking.
The unidentified witness said Brooks was too intoxicated to drive home, so Divens drove. When they got to Brooks’ house about 2 a.m. on June 8, Brooks asked for his keys. Divens pretended to chuck them onto the grass and then started to hand them to him.
Brooks then allegedly clocked Divens in the head with a beer bottle. Brooks allegedly began cursing and then struck him in the head again. Brooks allegedly asked Divens, “Do I need to get my (expletive deleted) gun?” and struck him again. Prosecutors also allege in the warrant that Brooks punched Divens.
Divens reportedly does not wish to press charges for fear of “this would be bad for both of their careers.”
